Chiemsee Apart Holiday Apartments - between Chiemsee & the AlpsDear guests, due to a stay abroad we rent our house with 2 apartments for a certain time. When we come back, we will stay here again. Both apartments are very comfortably equipped. The house Chiemsee Apart is located in the beautiful Chiemgau at the foot of the Alps and at the same time close to Lake Chiemsee - quietly located on the outskirts of the climatic health resort Prien am Chiemsee. The first bathing spots and the marina are 10 minutes away by bike. From the large south-facing windows of our house you look at the Kampenwand. The first mountain hiking/skiing area is about 30 minutes away. Behind the house begins the nature reserve ideal for sports. We have furnished our house in a timeless style, taking into account the Feng Shui theory of harmony. The light-flooded vacation apartment on the first floor is 111 sqm plus 50 sqm sun terrace and has 1 large bedroom with (intervertebral disc friendly, new mattresses) and 1 smaller bedroom with 1 bunk bed (2 separate beds). The smaller bedroom is only accessible via the hallway with its own (lockable) access. There is also a pull-out sofa bed in the living room, which could possibly sleep 1 - 2 more. A desk is available as a workplace. The kitchen and shower-bathroom are brand new and very modern. We have christened this apartment "garden view" - although this apartment also has mountain view. Guests of the very well equipped vacation apartment on the first floor can use the 50 sqm south sun terrace and the 12 sqm east terrace. Garden furniture, deck chairs, barbecue and a fire bowl for romantic evenings with campfire are available. The vacation apartment on the upper floor is 90 sqm and as an attic apartment has especially high rooms and a huge south panorama window. We have given it the name "Bergblick" because it not only offers a wonderful view of our garden, but above all it offers a view of the mountains and the adjacent landscape conservation area. This apartment is perfectly suitable for 2 people or a family with 2 children. It has a huge living-dining area with a nice well-equipped kitchen, 1 large bedroom (box-spring bed with new mattresses, 1.80 x 2.00) and 1 smaller bedroom with a double bed (1.40 x 2.00). Furthermore, there are 2 bathrooms in this apartment (1 shower bathroom with WC as well as 1 bathroom with bathtub without WC). A desk is available as a workplace. Service for guestsGuests of our house have free WLAN access. Both apartments are very well equipped with stereo, radio, TV, DVD player with movies to watch, sophisticated literature, travel guides, tips for excursions, board games, oven, stove with ceramic hob, dishwasher, hair dryer, etc.). Bed linen and towels are provided. For children there is 1 crib (incl. bed linen) plus 1 children's high chair. Our own washing machine, clothes horse, iron, ironing board in the basement can be shared by both apartments. For winter vacationers there are 2 sledges available. Also for skis there would be in the basement setting possibilities in the house. The apartment has its own parking space for our guests in front of the house. Bicycles could be parked on under the roof ledge.The neighborhoodOur neighbors are all very friendly and helpful. We all take a lot of consideration for each other. The residential area very quiet - here you can relax.Arrival and house briefingYou will receive briefing on the conditions of the house and surroundings from Freuden on site. You can arrive by car or by train. Our house is only 3 minutes by car and 20 minutes by foot from the train station in Prien. If you arrive by train it is best to order a cab in advance, so that one is available. Further important informationIn our house you will find a "Guest-Brevier", in which we will gladly give you insider tips and ideas for your vacation. In addition, we have compiled pampering ideas for you: from yoga, painting courses, yoga, wellness massages, cosmetics, vacation coaching ... you could also take advantage of a cooking service - whatever you feel like. We have tried all these activities ourselves and can recommend them. However, these offers are not to be booked through us - but separately. Whether summer vacation or winter/ ski vacation - we wish you a nice and happy vacation time in our house. About a recommendation and positive evaluation on your part, we would be very happy.1General Terms and Conditions of Chiemsee Apart GbR - Ferienwohnungen mit Stil§ 1 Validity of the Terms and Conditions(1) These terms and conditions apply to contracts for the rental of vacation apartments for accommodation as well as all for the Gasterbrachten other services and supplies of the provider. The services of the Provider are provided exclusively on the basis of these General Terms and Conditions of Business.(2) The subletting or reletting of the provided vacation apartment as well as its use for other than residential purposes require the prior written consent of the Provider.§ 2 Accommodation Contract(1) The accommodation contract is concluded when the Provider confirms the Guest's booking request by telephone or in writing by mail, e-mail and/or fax and thus accepts the booking (acceptance of request).(2) The Guest is obligated to check the booking confirmation for accuracy. If the content of the booking confirmation differs from the booking request and the Guest does not immediately object to this, the content of the booking confirmation shall be deemed to be contractually agreed.§ 3 Services, Prices, Payment, Offsetting(1) The Provider is obligated to keep the vacation apartment booked by the Guest available and to provide the agreed services. The vacation apartment corresponds to the equipment standard of an average rental apartment. The provider only assumes a guarantee for expressly promised features, but not for the subjective quality of the equipment (e.g. ventilation). (2) The guest is obligated to pay the applicable or agreed prices of the provider for the provision of the vacation apartment and the other services used by him. This also applies to services and expenses of the provider to third parties arranged by the guest.(3) All prices include the respective statutory value added tax.2(4) The guest is obliged to provide truthful information about the number of persons occupying the vacation apartment. The apartment is available for a maximum of the number of persons specified in the booking confirmation according to § 2 paragraph 1. The occupancy with a number of persons exceeding this number requires the prior written consent of the provider. In this case, the price for the provision of the vacation apartment increases to the price generally charged by the Provider for the corresponding occupancy.(5) The payment of the price agreed for the provision of the vacation apartment is made in two steps. As a rule, the guest pays the agreed price for his booking period at the time of the booking confirmation with 20%. 14 days before arrival, the price is to be transferred in full. (6) If the provider can not book until the 8th day after the transmission of the booking confirmation, and if this is not made after the expiry of a reasonable grace period set by the provider with a threat of refusal, the provider is entitled to withdraw from the contract he must notify the guest in writing. § 5 paragraph 3 is then to be applied accordingly with the proviso that the 8th day after the transmission of the booking confirmation is considered as the day of cancellation.(7) The Guest may only set off an undisputed or legally established claim against a claim of the Provider.§ 4 General rights and obligations house rules(1) The Guest must treat the vacation apartment and its inventory with care. The guest is obliged to comply with the house rules. From 10:00 p.m. to 7:00 a.m. the night rest is valid. During this time special consideration for the neighbors is required, also in the house entrances and staircases. In order to avoid disturbance, TV and audio equipment must be set to room volume.(2) For the duration of the rental of the vacation apartment, the guest is obligated to keep windows (except tilted) and doors closed when leaving the apartment, to set all radiators to a low level and to turn off lights and technical equipment. The skylights must always be closed when leaving the house!(3) The accommodation of pets of any kind is not allowed in the apartment. If animals are accommodated without the prior consent of the provider, the latter may charge a cleaning fee of up to &euro 500.00 (net).(4) Smoking is generally prohibited in the vacation apartment. In case of violations, the provider can charge a cleaning fee of up to 200,00 &euro (net). Smoking is only allowed on balconies and terraces.3(5) The use of the internet is allowed as long as it does not violate the legal regulations. Criminal acts (especially illegal downloads, page views) will be reported and prosecuted. The guest is solely liable for illegal use of the Internet.(6) The installation and/or attachment of materials for decoration or similar is not permitted in the vacation apartment. The guest is solely liable for any decoration or the like that is nevertheless installed and/or offered and indemnifies the provider from claims of third parties. He is also obliged to compensate for damages caused by the installation or attachment of decorations or similar.(7) The provider has the right of access to the apartment at any time, especially in case of imminent danger. When exercising the right of access, the guest's interests worthy of protection are to be taken into consideration appropriately. The Provider shall inform the Guest about the exercise of the right of access in advance, unless this is not reasonable or impossible under the circumstances of the individual case.§ 5 Withdrawal from the Contract (Cancellation)(1) A withdrawal of the Guest from the contract concluded with the Provider requires the written consent of the Provider. If this does not take place, then the agreed upon price from the contract is to be paid also if the customer does not make use of contractual achievements. This does not apply in cases of delay in performance by the provider or an impossibility of performance for which he is responsible.(2) The guest can, without triggering payment or damage claims by the provider, withdraw from the contract only if the possibility of withdrawal was agreed in writing between him and the provider by a certain date. This right of withdrawal of the guest expires if he does not exercise his right of withdrawal in writing to the provider by the agreed date, unless there is a case of default of performance by the provider or an impossibility of performance for which he is responsible.(3) Without triggering payment or damage claims by the provider, the guest is entitled to cancel up to 30 days before arrival, otherwise according to the following conditions: Cancellation of the booking amount of the overnight price to be paid up to the latest: 30 days before the start of the rental period 0 percent, 15 - 29 days before the start of the rental period 40 percent, from the 14th day before the start of the rental period 65 percent4Cancellations must be made in writing to the provider, unless the provider agrees to a verbal cancellation. The day of cancellation shall be the day of receipt of the cancellation by the Provider.(4) If the Guest does not appear on the day of arrival by 10:00 p.m. at the latest or by 60 minutes at the latest after a later time agreed in accordance with § 7 Paragraph 1 without having cancelled, the contract shall be deemed to have been cancelled. Paragraph 3 shall apply accordingly. In addition, the Provider may charge the Guest an administration fee in the amount of &euro 100.00 (net).(5) If the Guest's right to cancel within a certain period of time has been agreed in writing in accordance with Para. 2 was agreed in writing, the provider is entitled to withdraw from the contract during this period if there are requests from other guests for the contractually booked vacation apartment and the guest does not waive his right to withdraw upon inquiry by the provider.(6) Furthermore, the provider is entitled to withdraw from the contract for objectively justified reasons or to terminate the contract extraordinarily, if e.g.a) force majeure or other circumstances for which the Provider is not responsible make the fulfillment of the contract impossible,b) the vacation apartment was booked under misleading or false information of essential facts, e.g. in the person of the Guest or with regard to the purpose or with regard to the occupancy or with regard to the accommodation of animals. c) the vacation home is used for other than residential purposes,d) the Provider has reasonable grounds to believe that the use of the service endangers the safety or peace of mind of other guests or neighbors or the reputation of the Provider in public, without this being attributable to the Provider's sphere of control or organization. In cases of paragraph 6 a), the provider has to refund already made rent payments and / or advance payments without delay. In the case of justified withdrawal or justified termination by the provider, the guest has no claim for damages.5§ 6 Liability Limitation(1) The provider is liable for its obligations under the contract. The liability is limited to intent and gross negligence of the provider, if and to the extent that he is not absolutely liable according to the statutory provisions. If disturbances or deficiencies occur in the services of the provider, the provider will endeavor to eliminate the disturbance or the deficiency upon knowledge or upon immediate complaint of the guest. The guest is obligated to contribute what is reasonable for him to eliminate the disruption or defect and to keep any possible damage to a minimum.(2) The provider is not liable for items brought in by the guest they are not considered brought-in items in the sense of §§ 701 et seq. BGB. A liability of the provider according to these regulations is therefore expressly excluded. This also applies explicitly to valuables that the guest keeps and/or leaves in the vacation apartment.(3) The guest is liable for all damages that he, his fellow travelers or his visitors in the house of the vacation apartment, in the vacation apartment and / or on the inventory of the vacation apartment has / have culpably caused. A private liability insurance is recommended to the guest. The guest is obliged to notify the provider of any damage immediately. This applies in particular to such damage, which can also affect other apartments in the house (eg water damage, fire damage). (4) Claims of the guest expire in six months, unless the provider is liable for intent. Claims of the provider become time-barred in the respective legal period.§ 7 Arrival and departure, handover of keys late eviction(1) The vacation apartment is available on the day of arrival regularly from 16.00 clock.The arrival must be made by 20.00 clock, unless a later arrival time is expressly agreed in advance with the provider. An arrival before 16.00 o'clock can also only take place if this was expressly agreed in advance with the provider.(2) The guest is obliged to present his valid identity card or passport to the provider upon arrival.(3) The provider may require the payment of a deposit of 350.00 &euro upon arrival. The provider will refund this deposit if the apartment is vacated in time and all keys are returned on the day of departure or after the final cleaning, unless otherwise agreed with the guest and provided that the apartment has no damage for which the guest is responsible. In the event of further damage to the vacation apartment and/or inventory6 , the guest shall pay the amount of money required for compensation in cash on site (§ 249 para. 2 BGB).(4) On the day of departure, the guest must vacate the vacation apartment by 11.00 a.m. at the latest. In case of late vacating of the vacation apartment, the provider is entitled to an additional payment from the guest. This amounts toa) 50,00 &euro (net) in case of an evacuation after 11.00 a.m. but before 1.00 p.m. b) 100 % of the agreed accommodation price/night in case of an evacuation after 1.00 p.m. In addition, the Provider is entitled to compensation for all further damages incurred due to a delayed evacuation.(5) The evacuation according to paragraph 4 is only considered to be effected when all keys have been handed over to the Provider or his representative. For this purpose, the guest can leave all keys on the table in the apartment and close the apartment door, if this has been expressly agreed with the provider in advance. The guest is obliged to check the proper closing of the apartment door.(6) In case of loss of one or more keys, the guest has to compensate the provider for their replacement and, if necessary, for the installation of new locks.§ 8 PrivacyThe personal data provided by the guest, including the identity card or passport number are stored electronically by the provider. The data will not be disclosed to third parties unless this is necessary for the execution of the contract.§ 9 Final Provisions(1) Changes or amendments to the contract, the acceptance of the application or theseGeneral Terms and Conditions should be made in writing. Unilateral amendments or supplements by the guest are invalid.(2) The place of performance and payment is Rosenheim, Germany.(3) The contract shall be governed exclusively by the laws of the Federal Republic of Germany.(4) The exclusive place of jurisdiction - also for disputes regarding checks and bills of exchange - in commercial transactions shall be Rosenheim, Germany. If one of the7contracting parties has no general place of jurisdiction in Germany, the exclusive place of jurisdiction shall also be Rosenheim, Germany.(5) These General Terms and Conditions are protected by copyright. They are only intended for the personal use of the guest. Commercial use by third parties is expressly prohibited. The publication of these General Terms and Conditions on the Internet does not imply that they are made available to third parties for use or modification. (6) Should one of the above provisions be or become invalid or void, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision which comes as close as possible to the purpose of the provision to be replaced.
